Terms of Service
Last updated: January 2025
These Terms of Service ("Terms") govern your use of the TicketFair platform at ticketfair.co.uk ("Platform") as a ticket buyer or attendee. Please read them carefully before purchasing tickets or creating an account.
1. About TicketFair and Our Role
TicketFair is a technology platform operated in England and Wales that enables societies, clubs, and organisations ("Organisers") to create, manage, and sell tickets to their events directly to you.
TicketFair facilitates the transaction between you and the Organiser. When you purchase a ticket through our Platform, the Organiser is responsible for delivering the event as described.
Our role is limited to:
- Providing the technology infrastructure for ticket listing and purchase
- Facilitating secure payment processing via our payment partner, Stripe
- Delivering order confirmations and e-tickets on behalf of the Organiser
- Providing customer support for Platform-related issues (not event-related issues)
2. Your Account
You may purchase tickets as a guest or by creating an account. If you create an account, you agree to:
- Provide accurate, current, and complete information during registration
- Maintain and promptly update your account information
- Keep your password secure and confidential
- Accept responsibility for all activity that occurs under your account
- Notify us immediately of any unauthorised use of your account
You must be at least 16 years old to create an account. If you are under 18, you confirm that you have your parent or guardian's consent to use the Platform.
3. Purchasing Tickets
When you purchase a ticket through TicketFair:
- You are entering into a contract directly with the Organiser, not with TicketFair
- The Organiser sets the ticket price, event details, and any terms or conditions specific to their event
- Your payment is processed securely by Stripe and transferred to the Organiser (less applicable fees)
- You will receive an order confirmation and e-ticket via email
All ticket sales are subject to availability. We do not guarantee that tickets will remain available at the time you complete your purchase. A ticket reservation is held for a limited time during checkout; if you do not complete payment within that window, the reservation will be released.
4. Platform Fee
TicketFair charges a platform fee of 3.5% + 20p per transaction. This fee covers the cost of providing the Platform, payment processing, and related services.
The Organiser decides whether to absorb this fee or pass it on to you as a booking fee. Where the fee is passed on, it will be clearly displayed to you before you confirm your purchase.
TicketFair facilitates the transaction between you and the Event Organiser. The Organiser is responsible for delivering the event as described.
5. Refunds and Cancellations
If an event is cancelled by the Organiser, you will receive a full refund including the platform fee.
For change-of-mind refund requests (where the event is still going ahead), contact the Organiser via their event page. If the Organiser approves a refund, you will receive the ticket price back. The platform fee is non-refundable for change-of-mind requests.
If you are unable to reach the Organiser or they are unresponsive, contact us at support@ticketfair.co.uk and we will investigate.
Nothing in these Terms affects your statutory rights under the Consumer Rights Act 2015 or the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.
6. Event Attendance
Your ticket grants you a personal, non-transferable licence to attend the specified event, subject to the Organiser's terms and conditions. You agree to:
- Comply with the Organiser's event rules and venue policies
- Present valid identification if required by the Organiser
- Not resell tickets for profit unless expressly permitted by the Organiser
- Not duplicate, counterfeit, or tamper with tickets
7. Acceptable Use
You agree not to use the Platform to:
- Purchase tickets using fraudulent payment methods or stolen card details
- Circumvent any security measures, access controls, or usage limits
- Use automated tools (bots, scrapers) to purchase tickets or access the Platform
- Engage in any activity that disrupts or interferes with the Platform's operation
- Impersonate another person or misrepresent your identity
- Violate any applicable law or regulation
We reserve the right to suspend or terminate your access to the Platform if we reasonably believe you have breached these acceptable use terms.
8. Intellectual Property
The Platform, including its design, features, and content (excluding Organiser content and user-generated content), is owned by TicketFair and protected by intellectual property laws. You may not copy, modify, distribute, or reverse-engineer any part of the Platform without our prior written consent.
9. Limitation of Liability
To the maximum extent permitted by law:
- TicketFair is not liable for the acts or omissions of Organisers, including but not limited to event cancellation, postponement, change of venue, change of line-up, poor event quality, or failure to deliver the event as described
- TicketFair is not liable for any loss or damage arising from your attendance at an event, including personal injury, loss of property, or disappointment
- TicketFair's total liability to you for any claim arising from your use of the Platform shall not exceed the total amount of platform fees you have paid to us in the 12 months preceding the claim
- TicketFair shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill
Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited by English law.
10. Disclaimers
The Platform is provided on an "as is" and "as available" basis. We do not warrant that:
- The Platform will be uninterrupted, timely, secure, or error-free
- Event information listed by Organisers is accurate, complete, or up to date
- Any particular event will take place or meet your expectations
We do not endorse, verify, or guarantee any Organiser or event listed on the Platform. You should exercise your own judgement when purchasing tickets.
11. Privacy
Your use of the Platform is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal data. When you purchase a ticket, your name and email address will be shared with the Organiser so they can manage attendance and communicate with you about the event.
12. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will notify you by email (if you have an account) or by posting a prominent notice on the Platform. Your continued use of the Platform after changes take effect constitutes acceptance of the revised Terms.
13. Termination
You may stop using the Platform at any time. If you have an account, you may request its deletion by contacting us at legal@ticketfair.co.uk.
We may suspend or terminate your access to the Platform at any time if you breach these Terms, or if we are required to do so by law. Termination does not affect any rights or obligations that have already accrued, including any valid tickets you have already purchased.
14. Governing Law and Disputes
These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising from or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
If you are a consumer, you may also have rights under the laws of the country in which you reside, and nothing in these Terms affects those rights.
15. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
